Summary: | To the extent that the selection process for judges and cases is not adequately based upon principles of neutrality, the system will leave open the possibility that assignments were in at least some instances made in an effort to influence the outcome of a case. Such a system raises issues of partiality and calls into question the integrity of the decision-making process. Reform in this area requires increased transparency of the assignment process, a reduction of discretion, and a firmer legal basis for the requirement of neutral assignment of judges. |
