Summary: | Two years ago the European Commission (Commission) presented legislative proposals for reform of the current European Union data protection framework. The current Data Protection Directive (95/46/EC) (1995 Directive)' would be repealed by a "General Data Protection Regulation" (GDPR) proposed on Jan 25, 2012, and the Council Framework Decision 2008/977/JHA (Framework Decision) on the protection of personal data processed in the framework of police and judicial cooperation in criminal matters would be repealed by a Police and Criminal Justice Data Protection Directive (Justice DP Directive) proposed on the same date. Neither of the legislative proposals has yet been adopted. This article develops the context of the proposed legislation, investigates the legislative process (emphasizing the GDPR), details certain examples of lobbying with respect to the GDPR, explores relevant reactions to the NSA disclosures, and takes a look at prospects for the future through this new and different prism. |
