Summary:In Advisory Opinion OC-26/20, the Inter-American Court of Human Rights set forth the principles that apply to state disengagement with the Inter-American human rights system. Responding to a request submitted by Colombia, the AO addresses three issues. First, the “international human rights obligations of a member State of the [OAS] that has denounced the American Convention on Human Rights.” Second, it considers the “effects on the international human rights obligations of a member State of the OAS that is not party to the American Convention and has denounced the charter of the OAS.” And third, the relevance of the overarching collective guarantee embodied by Inter-American human rights instruments in the specific context of denunciations and withdrawals.
